VANRATH are recruiting a Commercial Manager to work for a specialist contractor, based in Co. Antrim, Northern Ireland.

Remuneration:
c£60,000 to £80,000 + package

Client:
Our client is a leading specialist contractor with a turnover of circa £100m+. They have been operating for approximately 50 years' and have a great reputation within the industry. As a result they are consistently securing more work and have a number of long standing client relationships.

Business is very busy and they have a strong order book for the next couple of years. They have a great opportunity for a Commercial Manager to join the business on a permanent basis, with a clear pathway to eventually step up to Commercial Director level and become a member of the board.

Overview of The Role:
The Commercial Manager is ultimately responsible for managing all commercial and contractual aspects for the structures division. The successful person will proactively develop the depth, the knowledge and experience of the commercial team to meet the needs of the business.

Responsibilities:

Winning profitable Contracts

  • Engage in the tender adjudication/review with advice and guidance for Sales and Estimating team on the contract terms and conditions, program, costs and delivery
  • Manage contract negotiations with the Sales and Estimating team to meet the company policy on standard contract terms
  • Attend pre-construction meetings for large contracts to ensure all commercial and contractual aspects of the contract are agreed with the client.



Delivering profitable Contracts

  • Responsible for all commercial aspects of the division including, the management of a commercial team, reviewing and challenging contractual documents, submission of timely and accurate applications, following up on payment and meeting monthly debt targets, involvement in estimating build-ups, contract reviews, interim valuations, variations and final account meetings
  • Commercial management within the team of sub-contractors to include tender, appointment, subcontractor quotations, appointment of sub-contract labour, contractual documents, payment terms, insurance reviews
  • Manage any commercial disputes with the client ensuring, professional leadership, adequate detailed backup documentation is in place, contractual expertise is demonstrated and closure of disputes are completed in a detailed and timely manner
  • Maintain a schedule of valuation dates and ensure relevant dates are met. Ensure client is notified of timely variations and these variations are agreed and closed out. Ensure prompt certification of all monies due
  • Monitor outstanding retentions to ensure that the earliest release is achieved, whilst attempting to reduce retentions with the cycle of new contracts
  • Process issue and control subcontractor payments including site measurement/valuations as necessary and costing of variations. Agreement and settlement of subcontractor final accounts including management of subcontractor retentions



Contracts Administration of Profitable contracts

  • Review Sub-contractor contract documents prepared by the team to ensure compatibility with main contract and control processing arrangements
  • Maintain a schedule of valuation dates and ensure relevant dates are met by the commercial team
  • Ensure clients are notified in a timely fashion of variations, instructions, program impacts etc. timely and these variations are agreed by clients
  • Monitor outstanding retentions to ensure that the earliest release is achieved, whilst attempting to reduce retentions with the cycle of new contracts
  • Ensure that contract documentation, including warranties, bonds and insurances are appraised and approved before commencement of works
  • Ensure that contract the commercial team submit and agree final accounts promptly upon practical completion date
  • Review or prepare commercial correspondence to clients



Reporting Performance

  • Revive with the team monthly financial information (CVR's) relating to contract performance identifying to ensure that current costs and costs to complete are regularly assessed, cost variations are analysed to update costs and budgets, external values are regularly updated and contribution forecasts are realistically assessed
  • Produce monthly financial reports forecasting company turnover, contribution, cashflow and risk items
  • Obtain agreement of Employer/Sub-contractor warranty documents, and control processing arrangements



Developing Team

  • Promote deeper contractual knowledge and commercial acumen for decision making within the senior management team, board and shareholders
  • Develop the depth of knowledge and experience of the Commercial team across the company to enhance the professional standard and competence of the business on standard forms of contract
  • Mentor the commercial team to develop their professional and practical competence
  • Propose an evolving program of training and education for the commercial team for board approval that demonstrates that the business can meet it objectives.



The Ideal Person:

  • 10+ years relevant experience in a commercial role within the construction industry
  • Proven track record of commercial acumen and commercial management of contracts
  • Thorough knowledge of contracts with design element clauses
  • Must have strong communication and negotiation skills with the ability to maintain positive relationships and take appropriate professional action when dealing with potential commercial difficulties
  • A thorough knowledge of JCT and NEC contracts with design element clauses
  • Limited travel will be required throughout the British Isles, utilizing technology where appropriate to minimize travel
